Lindsay Lohan likely to get house arrest after being sentenced to 120 days in jail for theft

Lindsay Lohan has pleaded 'no contest' to stealing a $2,500 necklace and been sentenced to 120 days in prison and 60 days of community service. But because of overcrowding, the actress will likely serve a fraction of her four-month sentence at her home in California.

Lindsay – who was absent from the hearing and represented by her lawyer – was ordered to surrender to Lynwood Jail on June 17 when it will be determined whether she will be fitted with an ankle bracelet and allowed to return home.

Even though the 24-year-old may serve her sentence from her Venice residence, it's thought she will be released after around two weeks, long before the end of her 120 day sentence.

An LA Sheriff's spokesman confirmed that Lindsay is eligible for home detention because she is a nonviolent offender without a serious history of crime.Judge Stephanie Sautner said that if the star is allowed to serve her sentence at home, she would not oppose the decision.She did however specify that Lindsay will not be allowed to serve the 480 hours of community service she was sentenced to for violating her probation in April during that time. Her latest 120 days sentence will run concurrently with the 120 days she also received last month. Lindsay was ordered to undergo psychological counselling and complete a 'Shoplifters Alternative Program'. Her probation has been extended for another three years.

Meanwhile, a probation report also released on Wednesday has revealed that the star failed a random alcohol test after leaving rehab.According to the document, Lindsay had been drinking when she snuck out of the Betty Ford Center in December – the night she scuffled with one of the clinic's employees.And she tested positive for alcohol in February, one week after her assistant surrendered the allegedly stolen necklace to the police.The report, released after her no-contest plea to the theft of the necklace – also states that Lindsay "has been suspected of similar conduct in other jewellery stores" but that no charges were ever filed.
