X Factor contestant Katie Waissel is overcome by nerves as the results are read out by Dermot O'Leary.
Luckily, for the bouffant-haired singer she was saved by the public vote – to her complete shock.
This meant Aiden Grimshaw, previously the bookies' favourite, had to go after he failed to convince viewers following a sing-off between the two.
But the controversy over her inclusion – despite continually being in the bottom two – refuses to die down.
Now it's emerged that she appears to have broken competition's rules stating that contestants cannot have a record contract while appearing on the show.
Katie has already had a track released in the US without the knowledge of the show's producers.
A track featuring her vocals was released on an album by South Carolina singer-songwriter David Reed on Friday.
Performing under the alter ego Lola Fontaine, Katie duets with David on a song titled Moving Mountains.
