A Los Angeles judge has agreed that Halle Berry can take her daughter Nahla to New York for a work commitment.
The ruling formed part of her custody battle with former partner Gabriel Aubry.
In December Gabriel filed court papers seeking to be formally recognised as Nahla's father and also establish shared custody.
The 33-year-old model apparently feared visits to his daughter would be jeopardised given that he and Halle had no formal visitation agreement.
He has since dropped his custody petition, but will continue his paternity action which will protect his paternal rights.
When the custody dispute became public, the 44-year-old cancelled plans to film romantic comedy New Year’s Eve in order to focus on her case.
The part was then given to actress Katherine Heigl.
Halle has since accepted another role in the film.
